#749245 RE: FOFreddie #749001

FOFreddie (& Robert indirectly at the end of the post), on the Davis Polk Primer... a couple of things to note: First, law firms of that stature would never allow someone who is not a practicing attorney to write those Client Update Insights without significant input and review from practicing attorneys. Second, the byline reads that David "contributed" to the Insights update which likely means he did the research and possibly even wrote the draft article; but I assure you experienced, practicing attorneys in that field would have had significant input, provided guidance, or actual authorship. Third, one shoud not tag or equate the validity or quality of the legal insight in that article with a "second year law student."

The full Juris Doctor (JD) is equivalent to a PhD, which is actually higher level than a Master of Laws (LLM) degree; it qualifies you to become a practing attorney where the LLM does not. Columbia is a top-tier law school, and by use of the byline for contribution, while being posted and presented to clients and readers in effect charges the Davis Polk law firm with all authorship and legal advice responsibilities - both pro and con.

Finally, with regard to Robert's work there is nothing at all "wrong" with what he is doing, in fact, it is positive if it is well-researched and written competently, and even better if it stimulates thought and interest from board members - all of which his efforts are doing. Where the urine fills my cheerios bowl is more a function of my penchant for opinions from credentialed professionals, frustration with the ocean of posts we weed through on ALL subjects without ever coming to any real answers, and this god-foresaken relentless ground hog's day nightmare of a conservatorship. Robert just happened to be in the line of friendly fire when my rifle discharged due to the BIG FAT doughnut hole batting average we have in the courts, the corrupt government rat bastards, and the defeaning silence from our seemingly witless shareholder attorneys. And for any offense that Robert may have inferred from my posts I trust that he will let bygones be bygones.
