It is critical in patent litigation that relies on hardware AND software to prove infringement. It is the pivotal point in this type of litigation in my opinion.
Source code will either reveal infringement or not. Simple as that.
Litigation efforts are spent on getting source code and analyzing it.
If you can pinpoint the infringement in the source code and can avoid being knocked out on a technicality............YOU WIN.
