I hope you can shed some light. My understanding is Judge Sweeney ruled a few years ago the derivative claims should move to trial and ruled against the direct claims. The direct plaintiffs appealed and lost. They appealed to SCOTUS and were turned down. Far as I understand the situation, the direct claims are still waiting for a trial.
