So KT, you've never tackled my "big idea" that the NWS violated the Major Questions Doctrine (a Seperation of Powers issue).

Exactly what is your legal argument that was not covered in Collins? Or any other case?

When you can't win on clear statutory grounds (as what should have happened in Collins), you've got a snowballs chance when you start talking about discretion in regulations.

And you haven't addressed the Doctrine of Res Judicata and Collateral Estoppel as well as any statute of limitations or Doctrine of Mootness.
