The request for a new trial will happen Jan 30

And most likely it will be denied. Davila is a seasoned judge and runs a tight ship so just like with Holmes and Balwani this motion will be denied for Schena and they they will reset the date for his sentencing. I'm assuming there will be an appeal after as well so it will come down to if Davila lets them stay out of prison while the appeal process plays out (for Holmes, Balwani and Schena). Personally I don't think Davila let's them stay out but we will see. It's just a slow train ride to the inevitable at this point. I think being in this process must be like a jail itself before going to actual prison. I mentioned before I don't think any of these motions work in Schena's favor. They are evaluating if he has any remorse and what his plan is to make everyone whole. Kinda hard to do when you have not accepted any responsibility and have fought the court the whole way through the process. We will see how it plays at the sentencing.

In the NY Taub case, it looks like that's coming down to the wire as well. It looked like they had an agreement in principal; however at the last minute Rene pulled out. So Taub is asking for a judgement of 24 million since there was no legal justification to cancel the agreement. Also they brought up the fact that Rene was banned from making any company decisions in her SEC agreement so that poses a problem for deciding anything in the Taub case. I believe the judge was waiting for a signed agreement from the Taub camp this week to make the next steps.

That leaves the 500K landlord suit which has been pretty quiet. If anyone has any updates please post.

So that's the update from the legal front. I believe TravO mentioned that they were revamping the website and it looks like they are going on as a company so I guess everyone will have to see what that looks like after all the dust settles.

And I'm just giving a summary from the Pacer postings. If I'm wrong about anything or misinterpreted any of the updates this is just IMHO. Feel free to correct me.
