Well, just because we aren't there yet...Star*Buds exists elsewhere --outside of NM--In seven states. We don't engage in the sale of coffee as a primary or even secondary biz line for instance.
If Schwazze were to negotiate and bring another name brand like Star*Buds to NM, notably as forementioned in a border town like Hobbs, or even if BR et al decided-on expansion themselves, the current name would likely be violative of their trademark as a deceptively similar tradename engaged in the same business. I think it a no brainer to obtain a cease-and-desist order now, before another dispensary is so named say in Albuquerque where the Albertson's overlap model could likely come into play, or if allowed to become injurious to their namesake and goodwill elsewhere?
