Again, a draft isn't submitting an application. An IDE application only has a thirty day consideration window. That draft was submitted when RDGL entered into pre-submission discussions well over a year ago now. It was never submitted as an application for human trials. Sadly that was only a day before MK's forecast window for submission closed, and he couldn't be bothered to tell shareholders as soon as he knew his forecast (2nd one that year) was no longer valid.
Ball remains in RDGL's court to apply for human trials.
