If what you suggest is true then why wouldn't the defendants run the stock price up so they don't have to pay any damages?

The share price drop in question is only from August 16 2012 to August 17 2012. Any move in the stock price since then is irrelevant.

And that's good for current shareholders. FMCC and all junior pref series trade higher than they did on August 17 2012.
