The doctrine of unclean hands relates to an appellate court not in terms of an affirmative defense which is what unclean hands really is but in terms of these appellate court judges being people and they are not prone to help a bad person. The fact that the appellant constantly disregarded court orders and has not complied with the judgment in terms of handing over the stock is not going to be looked at favorably by the appellate court.
I also believe the waiver argument was shot down by the appellate court
