Jury trial is better than positive summary judgement
Option 1: Let us assume summary judgment is in favor of the shareholders. Then government will certainly go for appeal.
Option 2: A positive jury judgment in favor of the shareholders is hard to appeal. Since, everything is still sealed, government is in hard place. If they go for jury trial then government has to reveal everything which Government may not like to broadcast $330B robbery.
Big questions for Friday night: Is harm denied as a part of 1st step for settlement? Is settlement on the table now? Are Collins & Rop judgments on hold for settlement?
