In March 2022, Boston Consulting Group (BCG) filed a lawsuit against GameStop for $30 million in unpaid fees.

GameStop said it refused to pay the fees because doing so was not in the best interest of GME shareholders.

The case is still awaiting trial

Means nothing. A motion to dismiss is based on whether the allegations in the lawsuit complaint, assuming they were true, would allow the plaintiff to win. You can allege any set of facts in a lawsuit. It doesn’t mean you are going to win just because your case is not dismissed.
