FHFA and UST know quite well the secret plan. Those emails now posted everywhere, are an embarrassment and it only shows that the U.S. Officials were directed to write emails and don't mention the secret plan, so that Pagliara and Co run the Govt theft story and the stock prices tumble. FHFA and UST know about it, not only because it's set forth in the law (Ain't an opinion. For instance, the July 2011 FHFA's Final Rule explains that dividends are restricted; a dividend depletes the capital and thus, inconsistent with its Rehab power; no dividend until Adequately Capitalized), but also because it has already been carried out with the FHLBanks in their 1989 bailout by Congress, with a provision called SEPARATE ACCOUNT where their 20%-of-profit installment was deposited, to repay the obligations RefCorp and the interest payments. Also a provision called TREASURY BACKUP at a 0% rate for a $300 million annuity, corresponding to the interests. FHFA is the regulator for the FHLBanks and in a 2011 press release, it claimed that the FHLBanks had only been paying interests, when their installment was applied also to the repayment of the obligation with the taxpayer. That's a secret plan right there.
With FnF, they tried something similar with a "dividend", not interests, taking advantage of the exceptions to the Restriction on Capital Distributions (like dividends), the exception B is the reduction of the SPS. A 10% dividend prompted a death spiral, so it was switched for the NWS dividend. The FHLBs didn't make interest payments when they reported losses.
Those covering up that a dividend is a capital distribution and thus, restricted, along with its exceptions, face charges of Making False Statements.
