I don’t think Evoco cares. They buy it from who’s selling it to them. The shell that used to be called Bioamber before it sold its trade name and was liquidated and suspended/deleted hasn’t reported making a sale since 2018, which makes sense given it has no employees to do anything. Nor does it have a plant to make anything or any IP etc.

Here's a link to that whole patent:

https://patft.uspto.gov/netacgi/nph-Parser?Sect1=PTO2&Sect2=HITOFF&u=%2Fnetahtml%2FPTO%2Fsearch-adv.htm&r=4&p=1&f=G&l=50&d=PTXT&S1=Evoco.AANM.&OS=AANM/(Evoco)&RS=AANM/Evoco

Now, do you reckon they might have done some of the research and development (ie - tests) ahead of their application filed February 16, 2021, when product from BioAmber was available?

Incorrect, "Bioamber" does very much exist but that new private company has nothing to do with company #4612067 - State of Delaware. As a matter of fact, it has nothing to do with the USA/Canada or shareholders.
Just like there are many "Betty's Cakes" named businesses in the world, there are other Bioamber's. Unfortunately the name that was previously attached to Delaware 4612067 was sold several years past.
So ya, "they" very much do know "Bioamber" exists, just not in it's previous composition.
