Logically, why would Auctus expose themselves to a jury trial knowing they would lose?

I can understand why PCT would do so.. because it would delay over 100,000,000 shares hitting the market and destroying the share price to the point raising capital would be impossible

Why else has PCT not increase its authorized shares by now?
