Attorney in Rop vs FHFA: "Fannie Mae common shareholders are not included in the class because the Court dismissed all claims brought on behalf of Fannie Mae common shareholders. The only claim that the Court allowed to proceed is one for breach of the implied covenant of good faith and fair dealing in the shareholders’ written agreements with the GSEs. Unfortunately, Fannie Mae common shareholders do not have a written agreement, so they do not have a viable claim for breach of the implied covenant."
