Second, the Senate-confirmed FHFA Directors who implemented the Third Amendment during the pendency of the parties’ longstanding dispute “were properly appointed” even though the President’s power to remove them remained
constrained. Id. (emphasis in original). Thus, the constitutional removal defect, the Court held, did not render “any of the actions taken by the FHFA in relation to the third amendment void.”

Importantly, however, the latter conclusion “does not necessarily mean . . . that the shareholders have no entitlement to retrospective relief.”

“The possibility that the unconstitutional restriction on a President’s power to remove a Director of the FHFA could have inflicted compensable harm CANNOT BE RULED OUT.”

Any theories about what this could mean for shareholders? I have no clue because all of the legal arguements we have had don't really discuss harm to the shareholders or the GSEs themselves.

The dissent is interesting

hhmm - the counter party (the one with the power - the demand for money) could have stopped the NWS anytime with a properly sworn in Top Dog

hhmm - the DJT administration had their people in there for a long time and did nothing to change things

hhmm

but ? anyone who really can read Court language

While the dissent is in favor of the Plaintiff (us - right) --- they note "it must be plausible" and maybe in the main decision - said we never made our damages clear enough?

I'm working and don't have time to read this over. That said, I can say the street is unimpressed since the stock is only barely green by less than a penny. That says nobody thinks this is a big deal.
