The NASDAQ capital markets up-list is a condition for the offering. So appears to me that he needs to meet minimum price threshold now. What he has done about the other up-list qualifications is another question. The lack of communication and the fact that he is a historical SOB is exactly why the price doesn't get any traction in my opinion.
