The whole point of my post, which is hard to convey over the internet the tone in which I take, is that time and circumstance matter. Yeah, it looked like you were listing the government's most recent arguments in the Collins case. My point-by-point response was not meant personally, I merely rebutted the arguments.

Those points of mine weren't meant to be an actual argument. I know there are steps in the process that are taken in specific order for good reason. Differing admins and policy objectives with those admins, changes circumstances.

Clearly I disagree here, and more importantly, so does David Thompson (in regards to #2/3/4/6). In the Fifth Circuit's oral arguments he pushed back against many government arguments of the form "if X was ever going to happen it would have happened by now", and those formed the bulk of your list.
