SEC investigations are private -- the evidence is they are issuing subpoenas. From the SEC website:

"All SEC investigations are conducted privately. Facts are developed to the fullest extent possible through informal inquiry, interviewing witnesses, examining brokerage records, reviewing trading data, and other methods. With a formal order of investigation, the Division's staff may compel witnesses by subpoena to testify and produce books, records, and other relevant documents. Following an investigation, SEC staff present their findings to the Commission for its review. The Commission can authorize the staff to file a case in federal court or bring an administrative action. In many cases, the Commission and the party charged decide to settle a matter without trial."

So the subpoena is evidence of an SEC formal investigation.

I said I can confirm the investigations; we will all find out at the same time if and when charges are filed.

My opinion is the company will be fined and Nader will go to prison as a 3x felon and that the Feds will clawback Nader ‘s and Kelly’s-profits on insider trading, subsequent to the fraudulent HIV BLA submission on April 27,:2020.

That email to Amarex is the nail in the coffin. Blatantly obvious that the stock popped on the news of the initial BLA filing, Nader knew it was not complete and would be rejected, and sold millions of shares within days of the PR on the initial filing.

I say initial filing, because even that was not done correctly, despite the PR, and an additional submission was made on May 11, 2020
