Ahhh but you would need to add a caveat explaining the harm fnf caused taxpayers… and discern the tipping point at which all Americans were restored to their 2007 normalcy and from there justify why fnf should be due any part of the $300 billion paid to your neighbors, family and friends …. As we all in some way through government services have or receiving( free covid shots, all kinds of monetary stimulus personal, business etc)

Great points. The points you make and others we are all to familiar with are why I am here after 14yrs. The ideas of right, wrong and justice I was brought up with keep me here unfortunately I thought I would make money on this. QQQ, AMZN, MSFT and apparently bitcoin all would have been better. My son outgrew his piggy bank while we were here. It also was better.

WooHoo! After nearly 14yrs of this, we finally got the courts to say that the government is the government. Wowee. It seems like the actual harm/remedy applied by what we, can finally call the government, is far from center stage. Instead, we have wrestling matches over discovery, standing, Whether the Judicial Branch, Constitution and Statutes read in plain English outweigh an all-too-convenient anti-injunction clause.

What has more discussion than the harm inflicted on the shareholders and the GSEs alike? Let's see if I can remember some of those more central discussions:

Humphrey's Executor. Oh yes! Incredibly famous, rolling off the tongues of every High School civics student. Certainly, we should use all the air discussing Humphrey's Executor because there wasn't any crime to see here folks.

Anti-injunction. In third world countries human shields are famously used by bad guys to prevent military action. In the US anti-injunction clauses are used to prevent legal action. In a way they are better than Human shields because they allow the enforcers of the law to avoid conflict with seemingly plausible reason. That way the Judges who consent to actions of the government which "...can do anything..." don't burn any political capital all while "maintaining the law".

Magic, superposition for physicists: The government is the government and isn't the government all at once. Abracadabra

For the governments next stupendous trick, the government will take the normally mutually exclusive actions of both receiver and conservator simultaneously. As a result, council is forced to spend more time on the "fulcrum is the word 'may'" tutorial in English rather than the actual blatant crimes. Of course, none of the Judges will recognize the obvious hierarchical section structure of the document nor plain English because every syllable out of context is effective defense for the government.

I just remembered this one: Moving the companies to DC and using that as an excuse for not following VA and DE state laws regarding securities even though the charters state that they follow DE and VA state security laws. (I'm making this one up but it applies) 'Well, they aren't incorporated in any state, so I guess only Federal Laws apply. Sucks to be you because there are no Federal Laws addressing the shareholder rights you claim under state corporate law.'

How about having the defendant avoid giving discovery materials with impunity repeatedly with no consequence that I know of.

The perpetrator of the crimes steps into the shoes of the victim preventing any plaintiff action. Thats all OK because the statute says so and how possibly could the government be accused of racketeering?
