Common sense.

If I owned a tobacco stock from 1970 - 1975, did I have to pay anything to a then-current shareholder when the tobacco company settled with the govt in the early 2000s? No. The current shareholders had the liability because the govt was suing the company.

Let’s say UDF loses the Bass lawsuit. Will the shareholders that sold 5 years ago send me a check for my share of the legal fees the company paid? Of course not.
