Here's co-plaintiff Marcus Liotta's response when I questioned this strategy:

SCOTUS was never asked to force the SPSPAs to be executed.

The MOELIS plan is crap, over-favoring the Government significantly.

SPSPAs were discussed in court to show the "way out" already offered was already unfair and was refused, proving the Government is just greedy.
