I think this is unlikely. I am not sure how HDVY would prove they did, nor how Intel would prove they didn't. The algorithm only uses standard simple arithmetic operations. I don't see anything special. Intel runs thousands of applications and algorithms on their CPU's to make sure they work (both the software and the hardware).

This was 2005 when patent ownership was unclear.
