You are likely familiar with the story but if not Desmarais (big time patent atty) was a lender and wanted the IP so he could fund P2 privately or I assume with an LLC of private investors and then peddle it to a larger player. Auctus evidently thought they could leverage their role but to do that had to make a bid to the BK judge to keep the commons and supply the financing. So BK Judge went with keeping the commons which is what Silva wanted to do as well though I think basically it was one debtor vs another. As an interesting aside to all this, the former VP has been bashing on twitter bitter about his loss, I think he had sided with Desmarais and would have been a player in the privatization of the IP. He has literally stated he would still like BRTX to fail and take the IP private. You're well informed, you may know these details better than I do and respect to you for your knowledge.
