Legal limbo is the norm. When you are a biotech and you have a vendor holding most/all of your clinical data hostage because you are $12 million dollars behind in your payments!! Yeah that's legal limbo and also clinical limbo.

As the company says, the lack of access to their data is delaying and jeopardizing their regulatory filings. That would be mTNBC BTD, HIV combo BLA, etc. That's a serious issue. We'll see how long it takes the company to payoff the debt that Amarex is claiming they are owed.

This legal limbo also highlights their financial limbo as they have $65 million in payables and only $8 million is cash as of the end of last quarter. That doesn't include the ~$55 million in vulture fund debt that is due in the forseeable future. Bad finances bring legal actions.

Scooter- INJUNCTION LIKELY NOT TO SUCCEED!! - If I put it in big letters it makes it look more official. 13D is a huge distraction and waist of time they don’t stand a chance of getting enough votes even if allowed to even be in the running. Something else I’m sure everyone knows. The fact that CyDy members were subpoenaed and not summoned is a huge difference. A subpoena means you are required to testify and summons when your are actually on trial for something . Not exactly the same thing. I would say no matter who anyone voted for there should be a stipulation that we vote for the 200 million shares only if the BOD works on a delayed payment program . Meaning all funds be used for the advancement of the drug , when we have approval then whatever portion of there salaries is held back can then be applied but only on approval. We don’t get paid for effort , that’s a pat on the back , I can guarantee working on paid by performance basis will wake some people up and get there ass on the move. If they don’t agree then no shares and they will have to find money from another lender. Im not sure at this point either group is big enough to advance this drug . That’s what the conversation needs to center on how to get this drug in the fight

Of course this is hindsight, but why was it likely to succeed.
