if the judge rules tomorrow against the former 13D gang of miscreants, will those who foolishly bought shares of IncellDX lose their investments knowing it will never get merged with CytoDyn?



Yes. It's why they're so vocal right now. There are posters here who personally funded Rosenbaum's attempted theft of Leronlimab BECAUSE they invested in IncellDX.

All those folks trying to convince you that the plot to buy IncellDX for $350m were lying because they all bought notes in the firm, awaiting the forced acquisition and a big payoff.

Hopefully the judge rules in Cytodyn's favor and they all fall on their sword or go back in the closet.

So CytoDyn wisely stopped paying Amarex due to its breach of obligations under the Master Services Agreement, which showed they had already paid them $80m.”

Here’s the problem: this is CYDY’s side of the story. We know that NP loves to spin a good story but many of those stories aren’t exactly true. Amarex will counter.

Recknor’s declaration of support doesn’t cite dates he reviewed Amarex’s data, but does says that CYDY requested in August of 2021 to review Amarex’s system and Amarex denied. August 2021? The unpaid invoices go back to June of 2020. When was this concern raised? July 2021? How did NP go from saying Amarex was so great to blaming them for all of CYDY’s trial problems in the last two months?. IMO, sounds like NP is setting up another scapegoat (similar to Pestell).

Remember: CYDY presented a similar story for Pestell and lost that lawsuit, costing the company over $7 million. Amarex will no doubt be responding to this lawsuit with their side of the story and documentation (they have 21 days to do so). This is going to be drawn out and there’s no way of knowing how long it will take to get the data from Amarex.
