Hahaha. Maybe it works out or perhaps it was a tactical error to put it on hold. We will have to wait and see.
There was a possibility of a win against MSFT in TX which could have helped sway the other Courts opinion or the appeal. A win or settlement with MSFT also would have provided WDDD some much needed financial stability as well as setting a precedent, which other Courts could use for guidance. Courts in a different Circuit don't need to follow the precedent but they can rely on the reasoning if they choose to. Some Courts don't want to reinvent the wheel and may have gone along with the legal reasoning from the Court in TX, which likely would have favored WDDD.
It's easy to second guess these things w/o all of the facts/information the attorneys had. I'm sure they had good reasons for putting the case on hold.
Just things to consider. Most of the "experts" here have disappeared or moved on and are not discussing the possibilities here.
