CYDY made allegations that forms were not filled out properly. 13D answered the complaint with information that rebutted the CYDY allegations and pointed out contradicting statements in CYDY’ s own complaint. CYDY also made mis statements regarding various parties sitting on BOD’s, which was easily debunked and pretty shoddy work product, for such high priced lawyers. That info should have been pretty easy to check. It will likewise be pretty easy to check if CYDY solicited offer from Patterson to buy IncellDx.
This will be litigated claim by counterclaim. I’m betting on 13D getting to put up their directors for a vote. There will be 2 vacant seats anyway. Millions more dollars of shareholders money down the drain to keep this failure as CEO. Be interesting to see the personal liability the BOD may have in these shenanigans
Nader has a horrible record to proffer if it comes to that, particularly the FDA rebuke. I can just see a judge sitting on the bench and shaking their head and pinching the bridge of their nose… “ Let me get this straight…The FDA said THAT ABOUT CYDY AND THE BOD DIDN’T FIRE THE CEO”??????????? LMAO.
NP will be a horrible witness. His style may work on some retail but will not work on a judge. The back tracking, hopefully’s etc. will get HIM CRUSHED. Moreover, since he is an egomaniac, he will be difficult to prepare and want to tell the story “his way”. I have seen this dozens of times and he will not be a credible witness. Only when he speaks in court, it will not only be the stock price that goes down… it will be the side NP is on. The market action after a CC or video is an excellent barometer of his credibility…zip, zero, Nada, Noddor.
