That's under APA. SCOTUS also ruled that Collins can pursue their claim under the constitution. Constitution trumps APA.

A high school student will agree with that. It seems to me lawyers either were not aware or they thought the SCOTUS is blind. In either case, they didn't do a good job.

so

it is not illegal

it is still a taking lacking compensation

(which was NOT argued that way -- it was argued to be an illegal act the court should declare illegal - to judge the TAKING as wrong ----- but the argument - next up and maybe stronger is --- fine -- so you have the right to TAKE - to build that highway through my property - I can not have a court INJUNCT your action ----- but now pay me fair and just value
