Agree, they seem to have standings instead of simply uphold the law.

The justices concluded that NWS decision was based on facts, while the GSEs would turn substantial profitable soon was only speculation. They ignored the email by Susan McFarland, the Fannie CFO in 2012, to FHFA management that “Fannie will be very profitable in the long term”. And they ignored the internal email by Jim Parrot, the senior housing advisor to BO Administration, to call for that “to make sure they can never exit Conservatorship”. And they ignored the fact that a DTA of $50B had been scheduled. This 2 emails and the DTA alone are enough evidence that the so-called death spiral was not true.
