Ruled this is now a takings case! The Gov now is shitting themselves.

If the 5th rules it is a Direct illegal taking then PAY UP OR GIVE IT BACK.. then the whole thing can be undone !

It seems that the government is having a hard time with full transparency during the Discovery Documents period, hiding behind, Executive Privilege, National Security, ANYTHING THAT MIGHT STICK.

Here, I think "Negotiations", simply means negotiations over letting Plaintiffs have access to documents in the defendants possession!

With the government continuing its "sweep" of victories in almost every single court hearing to date, I don't think they are inclined to give in an inch on giving up one thin dime of the $308B transferred from the two private enterprises to the UST.

EDIT2: Also, the "negotiations" are related to Plaintiffs' motion to compel production of privileged documents. This has nothing to do with negotiation of settlement; they're just trying to figure out which documents they need to give us.

(and bluntly - as this is JPS - right" ? --- if something good comes out for JPS -- it MUST both pragmatically and legally extend in some fashion to common !! People believe me when I say (for 10 years) JPS is equity not a debt or debenture ---- it is equity ---- and slicing JPS from common in either direction 100% --- just is impossible - one bleeds to the other - IMO 90% but even if 40% .... they are brothers or sisters not even just counsins)
