The CAFC will decide if they will hear the case. If the CAFC hears the case and believes errors were made, they would likely return the case to Casper with instructions on how to remedy whatever errors they found. One appealable issue I see is Casper did not hear from WDDD on part 2 of the 2 part process on 101. CAFC could instruct Casper to listen to the argument of WDDD. Does that change her mind or ruling? In my opinion probably not. The CAFC could also remove Casper from the case but that is a much less likely scenario. Usually that only happens if the case was returned to Casper and she declined to follow the guidance or instructions from CAFC. So it is a longshot here. We are still all waiting to hear from L4BC regarding his statement that Casper did us a favor with the 101. I can't seem to figure out how it is favorable that she ruled against us here.
