The instigators probably knew exactly what they could get away with and said the hell with shareholders and constitutional rights. By 2008, they had all the politicians in their pockets so who was there to stop them? Some agencies like the SEC had to be compromised. So it was David and Goliath all over again but David had no river rocks to hurl.
