I'm considering public sentiment/current market reaction very little going into this SCOTUS opinion. Public sentiment hopes have been dashed a number of times in the past. So public sentiment is suffering from....excuse the expression.....battered wives syndrome.

This SCOTUS opinion is looked at by the general investor through that lens, when the reality is that there is a very good chance that SCOTUS will rule on behalf of the plaintiffs. Nothing is for sure, however, so that negative feeling permeates the marketplace in advance of the ruling.

In fact, I believe that rulings for the plaintiffs are going to cause one of the most interesting market disruptions ever in commons, as there will be a range of forces and opinions that will create some major volatility for a while in volume and pricing.
