Rob, totally understand your point, and I think at a high level there are genuine similarities. I think the similarities stop there, at the 100k foot view.
Once the onion is peeled away the differences are material.
The only thing that made ACA unconstitutional was the tax you had to pay if you didn’t have HC. That was the only thing Roberts pointed to for him to side with the liberal judges. We all were told it wasn’t a tax but a penalty. Obama lied to the American people. When they got in front of the SC they said no it’s not a penalty it’s a tax. With out the tax mandate ACA is no longer an enforceable law.
