Excellent post. A ruling against us will not only be the death of capitalism but weaken the SCOTUS as well. A loss in Collins is the door to socialism. Justice Breyer said it best,”We don’t Nationalize Companies in this Country.”
That's all very good points. We have a (mostly) spineless judicial system when it comes to taking politicians to task, I whole hertedly agree. This is probably due to each new administration packing the courts with yes men/women opposed to what is needed.
Lower courts on this really got it wrong, and I think SCOTUS orals pin points that fact.
