This argument just falls down. If everything related to some “second transaction” was hidden by NDAs then you’d have no argument that a second transaction exists. For example, are the patent databases and old research report writers impervious to the NDAs? Why do some people get to “hint” at the “second transaction” while everyone has to say nothing?
Obviously there is no such transaction years after closing.
