I am just wondering if the merger can go ahead anyway. In reason, the share price should increase to a point where a settlement can be easily reached. Sello might be right, the merger may be the result of the lawsuit. However, it came after the lawsuit and may be a way to end the litigation. Honestly, I have no idea.
I just got off the phone with the Clerk of Court and was informed the mediation was not settled. That is a matter of public record you can call yourself.
