I don't see how IPIX wins this case. Signing documents and making contractual commitments without reading them is not a valid claim.

The letters between the lawyers are especially interesting to me. Those are included as part of the “Defendant Cummings Properties, LLC: Answer with a counterclaim”. I was pleased to see that IPIX contested the lease renewal in April 2018. That said, it was management incompetence to not have sent the proper written notice. Likewise, it was incompetence to not have read paragraph 2 of the 2013 lease renewal to appreciate the terms they put their signature to. Pre-trial conference is scheduled for March 25, 2022 which could make loanranger’s prediction that the current lease will expire before the case is resolved prescient. I expect that any company interested in doing business with IPIX will review this case.
