BCSC reschedules DeVries et al. holy promo hearing

The B.C. Securities Commission is rescheduling its hearing in the Amber Enterprises Ltd. holy promotion case. John DeVries, David DeVries, Ernest Grafke, Ralph Bromley and Wesley Campbell will now have until Jan. 29, 2007, to prepare their defences. The hearing was scheduled to start on Jan. 22, but the parties requested a last-minute adjournment.
According to the commission, DeVries et al. were promoters of a company called Amber Enterprises. In the spring of 2002, they began selling "partnership agreements" to investors. Mr. Campbell and Mr. Bromley, two pastors of the New Life Church of Kelowna, B.C., used their Christian credentials to back the promo. The BCSC alleges that, among other things, the respondents persuaded worshippers that God Himself had "breathed life into" Amber Enterprises, and that He wanted the faithful to invest. They did. The BCSC says the respondents bilked investors out of $10-million (U.S.). John DeVries et al. now face allegations of fraud, illegal distribution, misrepresentation and unfair practice.
In earlier filings, the respondents submitted an application to defend their actions on constitutional grounds. DeVries et al. said the Charter of Rights and Freedoms protects their right to make religious statements. They also argued that a mere hearing of the matter at the BCSC would violate their rights for it would hold their beliefs up for public scorn and ridicule.
