Supreme Court has passed on hearing several 101 cases. So far Supreme Court has not weighed in on the issue.

If case is appealed to CAFC, they would likely return the case to Casper with instructions or guidelines to correct whatever "errors" they seem appropriate.

If the CAFC loses confidence in Casper they could assign a different Judge to carry out their instructions on the issue.
