They can appeal but it is a long process. The chances of winning an appeal are slim unless there is a clear error by the District Court. Maybe the Court in Texas (MSFT case) views it differently, as it is a different District WD/TX and they don't necessarily have to follow rulings from the District of MA. However, they can consider the ruling.
