I'm not sure if you understand how an appeal works. Unless the appeal is late (so far everything is timely) or so unintelligible it can't be read, appeals don't get thrown out.

There are 3 main results.

Affirm
Reverse
Remand.

Affirm means they agree with the trial court.
Reverse means they don't agree
Remand in this case would probably mean go to trial or recalculate damages.

The court could affirm in part and reverse in part (for example, agree will all the court's orders but disagree on the damages award)

Appellant's brief is due May 26, GDSI's opposition is due 30 days after service, Reply is due 21 days after service.

So, July is almost a certainty before the first possible day this even gets in front of the appellate court. Since I do expect Rontan to request oral argument, it is most likely in front of the appellate court in September or October after oral argument. Maybe later.

It is not unusual and quite the norm for a decision and the writing of the decision to take a minimum of 6 months.

That is how I get to 2021. I am not sure who told you that a possible outcome is the appeal gets thrown out in June and I would say I am more likely to meet Elvis than that happening. If you mean that thrown out means that GDSI eventually wins, I agree. Most likely outcome.
