Yep, and that would up the pressure on the FDA to make it Federal.

The HHS secretary is an important "top down" source of pressure, while the states would provide "bottom up" pressure for enactment, just like MJ legalization.

Lots of foot dragging at FDA. Unable or unwilling to make cigarettes non-addictive. Time to get each state to make it happen, just like cannabis legalization.
