Issuing an injunction requires due process or must be so potentially harmful that society would demand it. If the summary judgement was thrown out as improper, then failure to remove the injunction would be an improper taking of rights without the ability to defend their position.
As for whether USRM violated the law, that would depend on whether one's own stem cells are in fact a drug.
I believe the problem that the court is faced with concerns how to regulate an industry in which the laws don't fully - or likely not even partially protect the average citizen. 99% of stem cell procedure is likely safe, but what about experimenting with things like stem cell use in eyes or the brain?
