Agree, We should start to move with reduced OS, here is what i think, April 15th we have the judge whom is scheduled to make his decision on the dismissal. PM knows they will not get a dismissal based on what PM already admitted too. Moreover, We know that they are stung with 3% out of 100% they infringed on HCMC Patent.
Considering 24% of all PM business is on said patent, world wide that is 16 billion in income for PM so 3% of 16billion dollars = 533 million Plus 3% royalty moving forward 533 million per year, last 3 years times 3X 1.5 billion due HCMC ALL Total 2.5 billion Owed HCMC.
Punitive damages 500 million plus attorney fees 33.3% of total award should bring it right around 3.5 billion dollars Now PM knows this and they have the money secure to pay off.
On denial from the judge, on PM REQUEST to dismiss, the PPS should move hard. Now if both these two ask for another stay, we know they are haggling things out. One more point (HCMC) is a little fish in a big pond, PM could eat them whole and never hick-up.
Guys it will come to an end pretty fast once the judge rules, bank on it!!!
