There's really no way of knowing if Tom can retrieve the assets even after taking legal action. The truth is it would depend on what Bill did with them. In my opinion, it's best to look at the company from the standpoint of them not having those assets anymore. I think most people who are still invested are doing so based on future potential. Not the original assets.
Even in your original question, you asked me for my opinion about whether or not the btc and cash is retrievable. The answer is maybe. But there are no guarantees because it would depend on how litigation goes. And yes. I think Tom should at least try to get it back. It's the right thing to do.
