They can come to a settlement at any time during the process of this entire lawsuit..

HCMC has responded, along with their response they proposed a form to the judge that they demand a trial by jury and that this motion to dismiss be denied. leaving blank a line for the judge to sign and approve.

The judge will either agree and move this along or he will ignore their proposal and allow PM for their final response before his determination on the motion to dismiss..
