Thanks for that clarification. I have no knowledge of patent litigation and appreciate your insight to clear up these questions . I am invested here partly for expecting settlements from litigation and partly because I see this as a growing company that will become profitable end of year. Litigation has cost us big time , but an end is in sight. Any day we could wake up a hear about a settlement or even buyout

It is standard in the process to make the challenge. What is not standard, is the challenge being taken up by the USPTO. This is what the bad sign is. Not just the challenge itself.
