By law the results also have to be released to the public in a timely fashion. The company can't just sit on the data if it's a 'material event', it must be disclosed.
Large pharmas can deep six failed trial results because they have vast pipelines, and a single drug/trial it isn't always 'material'. But for a small pharma with only one or two drugs, key trial results are a material event and have to be publicly disclosed.
That's one reason why I dislike that lying weasel CEO so much. I've known people like him. Good luck trying to pry the truth out that guy. If the data was good that guy would be singing it from the rooftops. They already have a ton of class action lawsuits and will likely get more.
